Military in Civilian Roles

Emergency Declarations in Executive Orders have put the military into civilian policing roles, further concentrating Executive power.


The Principle: Civilian Control of Law Enforcement

One of the fundamental principles of American democracy is the separation between military and civilian law enforcement. The military is designed to fight wars against foreign enemies under the Rules of War. Civilian law enforcement operates under the Rule of Law, with Constitutional protections for the People including due process, the right to a trial, and protection from unreasonable search and seizure.

When the military is used for domestic law enforcement, these critical Constitutional protections disappear. Under the Rules of War, enemy combatants can be killed without trial, detained indefinitely without charges, and subjected to military tribunals rather than civilian courts.

This is why the Posse Comitatus Act of 1878 generally prohibits the use of federal military forces for domestic law enforcement purposes.


The National Emergencies Act

The National Emergencies Act (NEA) of 1976 was designed to provide the President with emergency powers during genuine national crises. However, it was never intended to be used to circumvent normal Constitutional processes or to grant the President dictatorial powers.

The Act requires Congressional oversight and allows Congress to terminate declared emergencies. The problem is that this administration has been using the NEA without proper Congressional consent, effectively bypassing this critical check on executive power.


Executive Order: Designating "Antifa" as a Terrorist Organization

Trump's Executive Order using the National Emergencies Act (NEA) of 1976 to designate "antifa" as a terrorist organization is particularly dangerous.

Antifa is a philosophy that opposes a fascist form of government, period. Most Americans are antifa—they oppose fascism. This is not an organization with membership rolls or a central command; it's an ideology.

This designation empowers the President, as Commander in Chief of the military, to suppress protests under the Rules of War within our borders. Anyone who protests against this administration's policies could potentially be labeled "antifa" and subjected to military action rather than civilian law enforcement.

Executive Order: Designating Fentanyl as a Weapon of Mass Destruction

Trump's Executive Order using the National Emergencies Act (NEA) of 1976 to designate Fentanyl as a weapon of mass destruction (WMD) would shift drug enforcement from civilian control to the military and the rules of war.

Drug smugglers are criminals subject to the Rule of Law, not combatants subject to the Rules of War.

"Fact Sheet": Designating Drug Smugglers as Terrorists

Trump's "Fact Sheet" using the National Emergencies Act (NEA) of 1976 designates drug smugglers as terrorists.

Drug smugglers are criminals subject to interdiction and prosecution under the law. To designate criminals as terrorists by presidential edict subjects criminals to the rules of war, justifying lethal combat.

Murder on the High Seas

Trump's claim that every one of the boat bombings saves 25,000 lives is absurd on its face. As of January 2026, at least 100 people have been killed in over 36 boat strikes. According to Trump's claim, this would mean "saving" over 750,000 lives. However, total U.S. drug overdose deaths in 2024 were approximately 80,000—and that number has been declining for two years before any boat strikes began.

Most fentanyl enters this country through border crossings, not by boat. According to the DEA, "the vast majority of fentanyl is coming in the ports of entry" along the Mexico-U.S. border. Nearly 90% of fentanyl seizures occur at official Southwest border crossings, primarily in passenger vehicles driven by U.S. citizens. Venezuela plays only a minor role in drug trafficking to the United States.

The real reason for these orders is Venezuelan oil, which Trump openly claims is "our" oil. The administration has provided no evidence about the type or quantity of drugs allegedly on the boats, and legal experts have condemned the strikes as potentially illegal under U.S. and international law.

These military actions against civilian criminals represent a fundamental shift from law enforcement under the Rule of Law to military action under the Rules of War. This is how dictatorships operate.


Inciting Violence Against Lawmakers

When responsible legislators reminded members of the military that they are subject to prosecution for obeying illegal orders, Trump's response was:

- "Seditious behavior"
- Calling for them to "be arrested and put on trial"
- And that it could be "punishable by death"
- "HANG THEM GEORGE WASHINGTON WOULD"

This represents an attempt to intimidate civilian oversight of the military and to silence those who would remind military personnel of their Constitutional obligations.


The Expanding Definition of "Enemies"

Trump and his minions have designated anyone opposed to the fascist moves by this administration as "antifa," a terrorist organization. The entire Democratic party has been labeled a "criminal enterprise" (Stephen Miller) by this administration. The military has been called up to execute these edicts in our cities.

In other words, more than half of the American population is now subject to the rules of war, justifying lethal combat. How can anyone who loves this country support these steps toward dictatorship?


Put Together: The Complete Picture

With full power over independent agencies such as the FCC and the FEC, this and future presidents would control the media and our electoral system.

With the power to impound or transfer appropriations made by Congress, this and future presidents would control the purse strings and our economy.

With the power to use the National Emergencies Act without the consent of Congress (as he has done), this and future presidents would merge civilian policing with the military.

These are the very powers that dictators like Vladimir Putin and Xi Jinping possess.


Why This Matters: The Difference Between Law and War

Under the Rule of Law, the People have rights:

- The right to a trial by jury
- The right to due process
- Protection from unreasonable search and seizure
- The presumption of innocence
- The right to face accusers and present a defense
- Protection from cruel and unusual punishment

Under the Rules of War, enemy combatants have no such rights:

- They can be killed on sight without trial
- They can be detained indefinitely without charges
- They can be interrogated without lawyers
- They can be tried by military tribunal instead of civilian courts
- They have no Constitutional protections

When the President can declare anyone a "terrorist" or "enemy combatant" and subject them to military rather than civilian justice, Constitutional protections become meaningless.


Summary: The Military Is Not a Police Force

The use of military forces for domestic law enforcement represents a fundamental transformation of American government. It replaces the Rule of Law with the Rules of War. It replaces Constitutional protections with military expediency. It replaces civilian control with military domination.

Every dictatorship in history has used the military to suppress domestic opposition. By declaring political opponents, protesters, and even ordinary criminals to be "terrorists" or "enemy combatants," this administration is laying the groundwork for exactly this kind of authoritarian control.

The National Emergencies Act was never intended to grant the President the power to wage war on American citizens. Congress must reassert its oversight role, and the courts must reject these unconstitutional power grabs. Otherwise, we are no longer a republic governed by law—we are a dictatorship governed by the whims of whoever holds executive power.
